These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, which term shall include Vendors, Customers, Delivery Partners, and any other persons accessing or using the Platform) and Kokan Bajar (“Company”, “we”, “our”, or “us”), governing the use of the web and Android application known as Kokan Bajar (hereinafter referred to as the “Platform”).
By accessing, registering with, or using the Platform, you acknowledge and agree to be bound by these Terms. If you do not agree, you shall refrain from using the Platform.

1.4 Platforms Covered: Web and Android application.
2.1 The Company provides an online multivendor marketplace enabling Vendors to list, market, and sell products to Customers.
2.2 The Company operates on a zero-commission model, subject to payment of annual subscription fees by registered Vendors.
2.3 Delivery obligations rest solely with the Vendors. The Company may, at its discretion, integrate with third-party logistics providers (including but not limited to Shiprocket) to facilitate shipping.
2.4 The Platform further offers supporting services including Point of Sale (POS) solutions, Vendor Application, and payment facilitation. At present, payments are to be made directly to Vendors; the Company may, in the future, integrate with Razorpay or other payment gateways for direct settlements to Vendors.
3.1 Categories of Users include Vendors, Customers, Delivery Partners, Administrators, and Employees.
3.2 Vendor Eligibility: Vendors must (a) be Indian citizens of Marathi origin; (b) possess a valid mobile number, email address, bank account, PAN card, Aadhaar card, Udyam Registration, and other statutory licenses as required under Indian law.
3.3 Customer Eligibility: Customers must register with a valid mobile number and email address.
3.4 Age Restrictions: There are no age restrictions for Customers. However, persons below 18 years of age must transact through a guardian or legal representative.
4.1 Vendors shall provide complete and accurate information at the time of registration and maintain compliance with applicable laws.
4.2 Vendors shall ensure that product listings contain accurate descriptions, specifications, and categorization. Misrepresentation is strictly prohibited.
4.3 Vendors shall determine the pricing of their products. Predatory pricing practices intended to undercut fellow Vendors are expressly prohibited.
4.4 Vendors shall comply with all statutory requirements including, without limitation, GST, FSSAI licensing (for food products), intellectual property rights, and other applicable business licenses.
4.5 Vendors shall be solely responsible for order fulfillment, packaging, shipping, delivery, product quality, returns, and refunds.
4.6 Vendors are prohibited from listing illegal products, counterfeit goods, or any items infringing upon intellectual property rights of third parties.
5.1 Customers must provide accurate registration details and shall not engage in fraudulent or unlawful activities.
5.2 Payments shall be made directly to Vendors at the time of dispatch or prior to delivery, through Cash on Delivery, UPI, or Wallet payments. Future integrations may include payment gateways.
5.3 Standard delivery timelines shall range between 5–10 business days, for which Vendors shall be solely responsible.
5.4 Customers shall be entitled to returns and refunds within seven (7) days, subject to product eligibility and Vendor approval.
6.1 The Company acts solely as an intermediary and facilitator providing a platform for Vendors and Customers. The Company is not, at any time, the seller of products listed on the Platform.
6.2 The Company may, at its discretion, assist in dispute resolution between Vendors and Customers, but bears no liability for outcomes of such disputes.
6.3 The Company may facilitate payments through integrated gateways (e.g., Razorpay) in the future, with settlements made directly to Vendors.
6.4 The Company shall not be liable for vendor defaults, product defects, delivery delays, or damages of any kind.
7.1 All rights in the name, logo, application, website content, and design of Kokan Bajar vest solely with the Company.
7.2 Vendors shall be responsible for ensuring that their listings and activities do not infringe upon third-party intellectual property rights.
8.1 Vendors are the sole sellers of products. The Company functions as a facilitator only.
8.2 The Company disclaims all warranties, whether express or implied, including merchantability, fitness for purpose, or product guarantees, which rest exclusively with Vendors.
8.3 To the fullest extent permissible under law, the Company’s liability, if any, shall be limited to the subscription fee paid by the concerned Vendor.
9.1 The Company shall collect personal data including name, contact details, delivery address, and payment information.
9.2 Such data shall be used for the purposes of order fulfillment, analytics, marketing, and customer/vendor support.
9.3 Data may be shared with Vendors, logistics providers, payment processors, and governmental authorities, as required by law.
10.1 Vendor accounts may be suspended or terminated if Vendors:
(a) list illegal or counterfeit products;
(b) provide false or misleading information;
(c) engage in fraudulent or non-compliant activities; or
(d) otherwise violate these Terms.
10.2 Customer accounts may be suspended or terminated for fraudulent orders, misuse of the Platform, or policy violations.
10.3 The Company reserves the right to suspend or terminate any account, at its sole discretion, without prior notice.
11.1 These Terms shall be governed by and construed in accordance with the laws of India.
11.2 The courts at Mumbai, Maharashtra shall have exclusive jurisdiction to adjudicate any disputes arising hereunder.
12.1 The Company reserves the right to modify or amend these Terms at any time, at its sole discretion.
12.2 Any such modifications shall be notified through updates on the Platform, email, or in-app notifications.
12.3 Continued use of the Platform shall constitute deemed acceptance of the revised Terms.
By registering as a Vendor or Customer on Kokan Bajar, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
